PARTICIPATION AGREEMENT

To parent and student: Please read this Agreement before signing and making initial tuition payment - enrollment is not complete until this form is completed and payment is submitted.

  • Student Agreement: By completing this form, I accept membership in the Colorado Springs Youth Symphony Association and agree to follow all schedules, policies, and expectations.

    • As a representative of the Youth Symphony, I will conduct myself in a positive and professional manner and wear the required concert uniform, including natural hair colors and no visible piercings (other than ears) or tattoos.

    • If my school offers a music program, I will participate.

    • I will uphold the Association’s Rules of Behavior and address any emergency scheduling conflicts promptly and responsibly with the appropriate person.

    • I understand that failure to comply with this agreement may result in termination of my membership.

  • Parent Agreement: As the parent/guardian of a Youth Symphony Association member, I acknowledge my responsibilities to both the Association and my student.

    • I will remain current on all financial and fundraising obligations and ensure my child follows the Association schedule and participates fully. If a school music program is available, my child will participate.

    • I understand that any change in my child’s participation status must be submitted in writing to the office and that, unless a special exception is granted, I am responsible for full tuition for the season. Excessive absences or tardiness, inappropriate behavior, or unmet musical or financial obligations may result in dismissal. I accept responsibility for any damage to music or property caused by my child.

    • I authorize the Colorado Springs Youth Symphony Association to use my child’s name or photograph for press releases, stationery, direct mail, publicity, newspaper articles, the website, or other non-demeaning promotional purposes. When possible, advance notice will be provided.

    • I understand that camp, dress rehearsal, concert, and tour participation is required.


BEHAVIORAL EXPECTATIONS

As a participant in the Colorado Springs Youth Symphony Association, my student agrees to:

  • Be on time!

  • Respect and be sensitive to the needs of all members and those with whom I interact.

  • Participate fully and actively in all Association activities.

  • Listen attentively to instructions and be prepared, punctual, and properly attired for all events.

  • Demonstrate courtesy and professionalism toward musicians, staff, volunteers, audiences, and others at all times.

  • Maintain a quiet, focused, and professional demeanor.

  • Refrain from obscene or discriminatory language and from displaying or discussing drug-related or sexual content on clothing or jewelry.

  • Remain performance-focused at CSYSA events, reserving comments or critiques until appropriate times.

  • Take personal responsibility for my conduct, serving as a positive representative and example of the Association.

  • Exhibit good manners, flexibility, and a positive attitude.

  • Comply with the Rules of Behavior outlined in the Release of Liability, including the prohibition of tobacco, alcohol, and other drugs.


Disciplinary measures will include some or all of the following:

  • A verbal warning.

  • Conference with staff member(s).

  • Phone call to parents.

  • Conference with parents.

  • For special activities (tours, trips, concerts, parties, camp), parents may be required to pick up their child. If air travel is involved, parents may choose to have their musician return unaccompanied. The Youth Symphony Association will not be responsible for transportation beyond the airport for such students. Any expenses involved in getting a musician home will be the responsibility of the musician’s family.

  • Dismissal from the organization for serious infractions. Serious infractions are defined as engaging in illegal behavior, leaving the group, aggressive physical attack on another person.


As parents/guardians, I/we have discussed expectations and consequences with our child, and they understand what is expected and the consequences of deviating from those expectations.  I/we understand that if disciplinary action is taken that requires that my/our child be removed from an activity including tour, I/we will be responsible for all costs involved, including transportation. Transportation costs could include an adult accompanying a minor.


RELEASE OF LIABILITY

THIS IS A BINDING LEGAL DOCUMENT, PLEASE READ BEFORE SIGNING!

In consideration of my child (“Child”) being permitted to participate in the Colorado Springs Youth Symphony Association (“CSYSA”) ensemble listed above and all related activities, including concerts, rehearsals, camps, tours, and other events (collectively, “Activities”), I, on behalf of myself and my Child, agree as follows:

  • Compliance with Rules and Laws: My Child and I will comply with all CSYSA rules, policies, and instructions (copies of which we have received), and will support CSYSA leadership, staff, volunteers, and chaperones. We agree to comply with all applicable federal, state, and local laws while participating in any Activity.

  • Substance Use: My Child will not use non-therapeutic drugs or alcohol during any Activity. I will not be under the influence of non-therapeutic drugs or alcohol while present at any Activity.

  • Assumption of Risk: I understand that participation in the Activities may involve travel and interaction with the public and carries inherent risks, including but not limited to property damage or loss, injury, illness, or death. Some risks may be unknown or unforeseeable. If I or my child believe any Activity is not reasonably safe, we will not join the organization. I voluntarily assume all such risks on behalf of myself and my Child.

  • Release and Waiver: Except for damages resulting from the intentional misconduct or gross or willful negligence of CSYSA or its representatives, I release and waive any and all claims against CSYSA and its agents, directors, officers, employees, volunteers, chaperones, and representatives arising out of or related to participation in the Activities, including claims based on ordinary negligence. I assume full legal and financial responsibility for any loss, cost, or damage arising from my Child’s participation. I assume any and all Risks, known and unknown, and I assume all legal and financial responsibility for any losses, costs, and damages that may arise from any property damage or loss, injury, accident, illness, or death to my Child, whether caused, in part or in total, by the ordinary negligence of CSYSA.

  • Arbitration: Any dispute arising out of or relating to this Agreement or participation in the Activities shall be resolved exclusively by binding arbitration pursuant to the Colorado Uniform Arbitration Act and administered by the American Arbitration Association under its applicable rules. Arbitration shall occur in Colorado Springs, Colorado. The initiating party shall advance arbitration costs, subject to allocation by the arbitrator.

  • Consent and Acknowledgment: I consent to my Child’s participation in the Activities. I acknowledge that I have carefully read this Agreement, understand its terms, and understand that I am waiving substantial legal rights. I sign this Agreement freely and voluntarily, without inducement other than my Child’s participation in CSYSA Activities.

  • Medical Authorization: In case of emergency, if a parent or legal guardian cannot be reached after reasonable efforts, I authorize CSYSA and its agents to seek and obtain any necessary medical attention, evaluation, advice, or treatment for my child while participating in CSYSA activities. I understand that CSYSA will make reasonable attempts to contact me in an emergency. I agree to be responsible for and pay any medical expenses not covered by my insurance. CSYSA retains sole discretion to determine when an emergency exists. I hereby give my permission for CSYSA staff or CSYSA offical volunteers to administer over-the-counter (OTC) medications listed:

    • acetaminophen / Tylenol / ibuprofen / Advil

    • naproxen sodium / Aleve

    • PeptoBismol / Tums,

    • Benadryl / cough drops / throat lozenges

    • Emergen-C / Airborne / Sudafed

    • Neosporin topical gel / Calamine lotion / Cortizone cream
